No, the latest arbitrary and capricious reversal of administrative policy by the DH&HS will not survive the first round of nationwide injunctions by lower Federal courts.

The Trump administration is going to use this as a wedge issue to try to push the entire "can lower courts issue nationwide injunctions at all?" question to the Supreme Court. This is _fantastic news_, because it's hard to find a weaker post for them to hitch their horse to; they're just trying the first thing they can find as soon as they have an extra Justice on the court.

Problem for them is, it won't be enough: even assuming their latest puppet will react as expected, they've gone from 7-2 to 6-3, maybe 5-4, because the modern Supreme Court has a long track record of refusing access to higher courts where lower courts have unambiguously settled a question, and the precedent-minded judges _plus_ the liberal-leaning judges are not going to break the streak of delegating authority.

So after the injunction has stood for eight to ten months while the national injunction clown show takes over SCOTUS-related political headlines, it will continue to stand, and zero progress will have been made on the case itself. Whichever lower court made the injunction is not going to rule in the Executive's favor, so the Executive will appeal up to the Circuit court, which is also unlikely to rule in their favor. It's going to take at least an additional year and a half to produce enough of a circuit split to put the _issue itself_ before the Supreme Court, by which time we will hopefully have a new Chief Executive who will have directed the DH&HS to drop the whole thing, removing the Federal Judicial Branch's jurisdiction by making the entire conflict moot.
