All reports agree the Biden administration strategy is to just keep nominating judges and personnel across the bureaucracy. As that doesnt need the House theyre doing that, which even ifn
the House was functional would still be the plan

The key difference here is that Pelosi for any of her flaws would not have gone to a vote on the floor if it wasnt assured. She would have stepped down.

There have been people running for speaker in the last century who realized they didnt have the votes. NEWT GINGRICH did that.
